About these terms
We are Nasar Digital, the trading name of Nasar Pte Ltd (UEN 202534841E), a company registered in Singapore at 114 Lavender Street #07-83, CT Hub 2, Singapore 338729. "We", "us" and "our" mean Nasar Pte Ltd. "You" means the person or business using our website or services.
These terms cover your use of nasardigital.com and everything we provide: website design and builds, care plans, digital marketing, lead and messaging systems, and our free offers (together, our "Services"). By using our Services, you agree to these terms, our Privacy Policy and our Acceptable Use Policy.
Paid work is also covered by the proposal and Service Agreement we both sign. If your signed documents and this page differ, your signed documents win.
Who can use our services
- You must be at least 18 years old.
- If you act for a business, you confirm that you are allowed to agree to these terms for it.
- The information you give us must be true and kept up to date.
- You must not use our Services if the law, including sanctions law, does not allow us to work with you.
How projects work
- We send a proposal and a Service Agreement together. Work starts once both are signed and the deposit is paid.
- Your proposal sets out what we will deliver, the price, the timeline and the payment steps.
- Timelines depend on you sending content, feedback and access when we ask. If these arrive late, the timeline moves by the same amount.
- Your proposal says how many rounds of changes are included. Extra changes, or new work outside the proposal, are quoted separately before we start.
- We will ask you to check and approve the work before launch. Once you approve it or the site goes live, the project is complete, apart from fixing our own mistakes.
Care plans and lead systems
Some Services are paid monthly, such as our website care plans and our lead, booking and messaging systems ("Monthly Plans").
- Monthly Plans start on the date in your agreement and renew automatically each month until cancelled.
- What each plan includes, such as hours of changes, is set out in your proposal. Unused hours do not roll over.
- If your agreement has a minimum term, the plan runs for at least that long.
- Our lead systems run on third-party software that we set up and manage for you under our own account. You get your own login to use it, but the account belongs to us. See Who owns what.
- Any free months or setup discounts are offered deal by deal and are written into your proposal.
- We may change Monthly Plan prices or features. We will give you at least 30 days' notice of a price increase, and you may cancel before it starts.
Prices and payment
- All prices are in Singapore dollars (S$).
- Nasar Pte Ltd is not registered for GST, so we do not charge GST. If we become registered, we will tell you and add GST from then on as the law requires.
- You can pay by bank transfer, PayNow, or by card through our payment providers, Stripe or HitPay. Your invoice shows the options.
- Invoices are due on the date shown on them. Monthly Plans are billed in advance each month.
- Card payments are handled securely by the payment provider. We do not see or store your full card number.
- Your bank or card issuer may charge its own fees, such as for currency conversion. We do not add hidden surcharges.
- If we find a clear billing mistake, we will correct it and tell you before charging any extra amount.
- If a payment is more than 14 days late, we may pause work or the affected Service after telling you. We may also recover reasonable costs of collecting overdue amounts.
Cancelling and refunds
- Projects: the deposit secures your place in our schedule and pays for work we start. If you cancel a project, you pay for the work done up to that point, as set out in your Service Agreement.
- Monthly Plans: cancel any time by email or WhatsApp. The cancellation takes effect at the end of the month you have paid for, and you keep the Service until then. We do not refund part months.
- Other refunds are at our discretion, unless your agreement or the law says otherwise. If you are unhappy, please talk to us. We would rather put things right.
Your part
- Send the content, feedback, logins and approvals we need, on time.
- Make sure you own or have permission to use anything you send us, such as text, photos, logos and customer lists.
- Check the content on your website is accurate, including prices, claims and legal pages for your own business.
- Keep your own logins safe, and tell us quickly if you think an account has been misused.
- Follow our Acceptable Use Policy.
If someone makes a claim against us because of content you supplied or messages you sent through our Services, you agree to cover our reasonable losses and costs from that claim.
Messaging rules for lead systems
If you use our Services to send WhatsApp, SMS or email messages to your customers, you are responsible for those messages. You agree to:
- only message people who have given you permission, or who already have an ongoing relationship with you as the law allows;
- follow Singapore's Personal Data Protection Act (including the Do Not Call rules), the Spam Control Act, and WhatsApp's business policies;
- include an easy way to opt out, and stop messaging anyone who opts out;
- never upload bought or scraped contact lists.
We may pause messaging on your account if we see spam complaints, high opt-out rates, or a risk to our messaging accounts.
Third-party platforms
Our Services rely on other companies, such as HighLevel (our lead and messaging software), Hostinger (hosting), WhatsApp, Google, Stripe and HitPay. When you use these through us, their own terms also apply.
We choose these providers with care, but we do not control them. If one of them has an outage, changes its features or prices, or stops a service, we will do our best to limit the impact on you, but we cannot be responsible for their failures. If a provider raises its prices to us, we may adjust our Monthly Plan prices with 30 days' notice.
Who owns what
- Your website: once you have paid in full, the website we built for you, its design and the content made for it are yours. If you ever leave, we hand over your files.
- Your content and data: your logo, text, photos and customer data stay yours at all times.
- Our tools: we keep ownership of our own templates, code libraries, workflows, know-how and methods, which we reuse across clients. You get a lasting right to use any of these that form part of what we delivered to you.
- Third-party items: themes, plugins, fonts, stock photos and software are licensed from their makers under their own terms. Some need yearly renewals.
- Lead systems: the software account, automations and templates we build in it belong to us. If you cancel, we will export your contacts and conversation data to you on request within 30 days.
- Our portfolio: we may show the work we did for you, such as screenshots and a short description, in our portfolio. Tell us in writing if you would rather we did not.
Our own website, brand and materials belong to us. Please do not copy them, or use our name or logo in a way that suggests we endorse you, without asking.
AI tools
We use AI tools to help draft copy, create images, summarise meeting notes and handle routine admin. A person on our team reviews AI output before it reaches you. Some lead systems include AI features, such as automatic replies. These can make mistakes, so you should check how they answer your customers, and tell us if something needs changing.
Free offers
Our free growth diagnostic and free 30-minute call come with no obligation. What we tell you is our honest view based on what we can see. Results depend on many things outside our control, so we do not promise a particular outcome.
A free yourname.nsd.sg address is free for 30 days. After that you can ask for more time or upgrade. You are responsible for what you publish on it, and we may remove content that is illegal, harmful, or breaks someone else's rights. Free hosting comes as it is, with no uptime promise, so keep your own copy of your files. We may change or end any free offer at any time.
Using this website
- The content on this site is general information. It is not advice for your business until we have looked at it together.
- We try to keep this site accurate and up to date, but mistakes can happen. We will correct them when we find them.
- The words, design and images on this site belong to us or to clients who let us show their work.
- Links to other websites, such as our clients' sites, are there for your interest. We do not control those sites.
- Please do not try to hack, overload, scrape or misuse this site.
Our responsibility
We do our work with reasonable care and skill, and we fix our own mistakes at no charge. Apart from that and what your agreement says, our Services are provided as they are, and we do not promise they will be uninterrupted or free of errors, or that they will bring a particular number of leads, sales or rankings.
- We are not responsible for indirect losses, such as lost profits, lost business, lost data or damage to reputation.
- We are not responsible for problems caused by things outside our reasonable control, such as outages at hosting, software or payment companies, internet failures, cyberattacks or natural disasters. If one of these happens, we will tell you and resume work as soon as we can. You still pay for work already done.
- Our total responsibility to you for any claim is limited to the fees you paid us in the 12 months before the claim arose.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Pausing or ending services
We may pause or end a Service if you seriously break these terms or our Acceptable Use Policy, if payment is overdue, or if the law requires it. Where we can, we will tell you first and give you a chance to fix the problem. You may end a Service as set out in Cancelling and refunds and your agreement.
If there is a disagreement
Talk to us first at hello@nasardigital.com, explaining what is wrong and what you would like us to do. We will try to sort it out with you within 30 days. If we cannot, we will both try mediation at the Singapore Mediation Centre before going to court. Either of us may still go to court urgently to protect intellectual property or confidential information.
These terms are governed by the laws of Singapore, and the Singapore courts have jurisdiction.
General terms
- Changes: we may update these terms. We will change the date at the top, and tell clients about important changes at least 14 days before they apply. Changes do not affect work already agreed in a signed proposal.
- Notices: email is enough for any notice under these terms.
- Whole agreement: these terms, our policies and your signed documents are the whole agreement between us. Terms in your purchase orders or other documents do not apply unless we agree in writing.
- If part is invalid: the rest of these terms still apply.
- No waiver: if we do not enforce a right straight away, we can still enforce it later.
- Transfer: you may not transfer your agreement to someone else without our written consent. We may transfer ours to a company that takes over our business, and your rights will not be reduced.
- Third parties: no one else has a right to enforce these terms under the Contracts (Rights of Third Parties) Act 2001.
- Your statutory rights: nothing in these terms takes away rights you have under Singapore law that cannot be excluded.
